Goswappix Terms of Use
In short
- What we are. Goswappix is a listings board and an agreement tool. Here people find a counter-route, agree on terms and talk to each other.
- What we do not do. We do not accept, hold or transfer money. We have no wallet, balance, deposit or escrow account. We are not a bank, an exchange office or a guarantor of the deal.
- Who is responsible for the money. Only the members themselves. Each member hands money to a recipient in their own city and carries the risk. We do not confirm that money was handed over and cannot return it.
- Money disputes. We do not decide who owes whom. Members agree between themselves and close the deal themselves. Support reviews only breaches of the platform rules.
- 18+ only. You may use the service only if you are 18 or older.
- What gets you removed. Fraud, pressure, threats, money laundering, evading sanctions, moving money for others as a business without a licence, someone else's or multiple accounts, fake reviews. Blocking applies to the phone number and the device.
- The law of your country. You check yourself whether such handovers are allowed where you live and where the money is received.
1. Who we are and what this document is
1.1. The Goswappix service is the website goswappix.app and the apps for iPhone and Android. The operating company is being registered in France; its name, address and registration number will appear here once it is registered. Contact: support@goswappix.app. Below we call ourselves "we".
1.2. These terms are a contract between you and us. They are the same for everyone, and you accept them as a whole.
1.3. You accept the terms when you tick your agreement with them at sign-in. You cannot use the service without agreeing. We record when you agreed and to which edition.
1.4. Together with these terms, the following apply:
- the Privacy Policy: goswappix.app/legal/privacy;
- the safety rules and trust levels: goswappix.app/safety;
- the frequently asked questions: goswappix.app/faq.
If anything on those pages conflicts with these terms, these terms prevail.
2. Words we use
- Request — your listing: where you hand over money, where your person should receive it, the amounts and the method.
- Counter-request — a request with the opposite route.
- Deal — an agreement between two members about two opposite local handovers.
- Handover — handing money over within one city: from one member to the other member's recipient.
- Recipient — the person who receives money in their city. This can be the member themselves or someone they know.
- Deal terms — amounts, recipients, order of handovers and deadline. They are recorded as one version that has a "fingerprint".
- Case — a message to support: a question, a complaint or a report of a problem in a deal.
- Voucher — a member who has vouched for another member with their own trust level.
3. What Goswappix does and does not do
3.1. What we do.
- Show requests and counter-routes.
- Check requests before they are published.
- Provide a deal chat.
- Record the deal terms so that both sides see the same thing. Any change creates a new version, and both agree again.
- Send the recipient an SMS with a link so they can confirm their participation.
- Show a "meeting code" so the person handing over can check that the right recipient is in front of them.
- Send the recipient a code with which they mark the receipt themselves.
- Open the second handover only after the recipient of the first one has marked the receipt.
- Keep reviews, ratings, vouches, trust levels and limits.
- Review complaints about breaches of the platform rules.
3.2. What we do not do.
- We do not accept, hold, carry or transfer money. We have no wallet, balance, deposit or escrow account.
- We do not exchange currency or set a rate. Members agree on the amounts themselves. The rate we show is used only to convert your limit into dollars.
- We are not a party to the deal, nor a representative or agent of a member.
- We do not confirm that money was handed over or received.
- We do not guarantee that the other side keeps their promise.
- We do not return or recover money.
- We do not resolve money disputes or decide who is right.
- We do not verify members' identity. We do not ask for documents.
3.3. What the marks in the service mean. The "received" mark is a statement by the recipient entered with their code, not our confirmation. Checking the meeting code only shows that the person has the right screen open. It does not prove identity and does not confirm a handover of money. The "I handed it over" mark is only a statement by the person handing over. The "number confirmed" mark only means that the person received a code on that number.
3.4. Risk of the first handover. The service cannot make two handovers in two cities happen at the same time. Whoever hands over first takes a risk. The order of handovers, limits, reviews and vouches reduce the risk but do not remove it.
3.5. The service is currently free. We take no commission and add no margin through the rate. If a fee appears, we will tell you in advance and ask for separate consent.
3.6. Cryptocurrency is currently switched off in the service. Requests with cryptocurrency cannot be created.
4. Who may use the service
4.1. You are 18 or older and can enter into contracts under the law of your country.
4.2. You act in your own name and in your own interest. You may not use the service on behalf of another person for payment, run someone else's account or hand over yours.
4.3. One person, one account. You may not open a new account after being blocked.
4.4. You may not use the service if:
- sanctions apply to you. We do not screen members against sanctions lists: by accepting the terms you confirm that no sanctions apply to you;
- the law of your country or of the recipient's country forbids such handovers or requires a licence for them that you do not have;
- you have already been blocked on Goswappix.
4.5. Countries and routes. We may restrict the service in certain countries and cities if the law or members' safety requires it.
4.6. Your responsibility for the law. You check and comply with the laws of your country and of the recipient's country yourself: currency, tax, anti-money-laundering, sanctions and payment services laws. We do not give legal advice and do not claim that handovers via counter-routes are legal anywhere.
5. Account and sign-in
5.1. You sign in with your phone number and a one-time code. The code arrives in Telegram or by SMS. There is no password.
5.2. The code is valid for 5 minutes. Never share it. Goswappix staff never ask for codes, bank passwords or CVV.
5.3. After your first sign-in you choose a nickname. It is set once and cannot be changed. The nickname must not:
- pass you off as Goswappix staff or another person;
- contain contact details, insults or advertising.
5.4. You are responsible for everything done from your account until you tell us it has been compromised. You can see your sessions in your account and end them.
5.5. Give true information about yourself and your recipients.
5.6. You may add an email address in your account if you wish. You still sign in with your phone number.
6. Requests
6.1. A request is checked before publication. We may refuse to publish it and will give the reason.
6.2. Phone numbers, links and other contact details are not allowed in a request description or in comments. The service looks for them automatically and does not accept such text.
6.3. You can have no more than 3 open requests at a time. A request stays open for no longer than 14 days.
6.4. State only your real intentions. You may not publish a request in order to:
- collect contact details;
- lure someone to a meeting;
- test demand or fill the feed.
7. Trust levels and limits
7.1. Every member has a trust level. The level sets a limit: how much, in dollar equivalent, can be in all your open requests and deals at the same time.
7.2. A newcomer has up to 500 USD in equivalent. Higher levels open after completed deals, time in the service and three vouchers. The table of levels is on the "Safety" page.
7.3. We calculate the equivalent using rates from open sources (the European Central Bank and others). This rate does not affect the amounts you agreed on.
7.4. You may not get around the limit: split an amount, open a second account or ask someone else to create a request for you.
7.5. Limits are a safety measure of the platform. They are not an assessment of your solvency and not a guarantee that other members are honest.
8. The deal
8.1. Offer and reservation. A member sends an offer on a counter-request. Once it is accepted, both requests are reserved for the deal for a short time. The time limits are shown in the service.
8.2. Terms. Amounts, recipients, order of handovers and deadline are recorded as one version. Both sides see the same version and the same fingerprint. Any change creates a new version. Both agreements are then reset and you need to agree again.
8.3. Only the terms fields count. Only the terms recorded in the deal are binding. A chat message does not change the recipient, the amount or the details. Do not hand over money based on new details from the chat.
8.4. Start. When both sides have agreed and pressed "ready to start", the terms are fixed and no longer change.
8.5. Handovers in turn. The first handover opens at the start. The second opens only when the recipient of the first has marked the receipt of the full amount with their code.
8.6. Meeting. For cash, choose a safe public place. Before handing over money, check the meeting code on the recipient's screen. If the code does not match, hand over nothing.
8.7. Completion. The deal is complete when both recipients have marked the receipt.
8.8. Before the start either side may stop the negotiations with no money consequences.
9. Recipients
9.1. By naming a recipient you confirm that you know them, that they expect this money and that they agree to you giving us their name and phone number. More in the Privacy Policy.
9.2. The recipient receives an SMS with a link and confirms their participation themselves. Without their consent the deal will not start.
9.3. When a handover opens, the recipient receives an SMS with a link. They mark the receipt with a code that only they receive.
9.4. The recipient marks the receipt only after counting the full amount themselves. Not on a promise, not on a screenshot and not on a bank SMS.
9.5. No one but the recipient enters their code. You may not ask the recipient for their code or enter it for them.
9.6. If the code is entered wrongly 10 times, the handover stops and a support case opens automatically.
10. If something goes wrong
10.1. "There is a problem". Any member or recipient can press "There is a problem". The deal stops: new steps are paused and everything so far is kept.
10.2. Do not hand over anything else. While the deal is stopped, do not hand over money or codes "to speed things up".
10.3. You close the deal. A stopped deal is closed by the members themselves:
- both mark "we have settled" — the deal is closed as settled;
- either one marks "close without settlement" — the deal is closed without settlement.
The "without settlement" mark does not mean anyone is at fault. We do not decide the money outcome and do not record who owes whom.
10.4. Returning money is something you agree on between yourselves. We do not take part in a return and do not confirm it.
10.5. Police and courts. In case of fraud, go to the police or to court. In your account, under "My data", you can download an archive of your deals, messages and cases. On a lawful request from the authorities we may hand data over to them (section 13).
10.6. Emergency help. The service does not call the police and does not provide physical safety. If you are threatened, call the emergency services of your country.
11. What is forbidden
11.1. Money and the law. You may not use the service:
- to launder proceeds of crime or to finance terrorism;
- to evade sanctions, currency restrictions or bank requirements;
- to run a money transfer business without the required licence or registration: regularly making handovers for other people for a reward, collecting money from people to pass on, working as a "cash desk" or intermediary;
- for handovers linked to drugs, weapons, human trafficking, unlicensed gambling or other illegal activity;
- to evade taxes;
- for handovers if the money is not yours or you do not know where it comes from.
11.2. Fraud and pressure. You may not:
- deceive, swap the recipient, change details in the chat;
- pressure the recipient to mark the receipt before they have counted the money;
- ask for or trick people into giving codes;
- threaten, insult or harass;
- deliberately not turn up to a meeting or wreck deals;
- pass yourself off as Goswappix staff or another person.
11.3. Accounts. You may not:
- open several accounts or a new one after being blocked;
- hand over, sell or buy accounts;
- get around limits and levels.
11.4. Reviews and vouches. You may not:
- inflate reviews and ratings or agree on mutual ratings;
- trade vouches, vouch for strangers or for payment;
- write threats or personal data in reviews.
11.5. Other people's data. You may not publish other people's phone numbers, addresses, documents or photos without their consent.
11.6. Technical. You may not:
- collect data from the service with programs without our written permission;
- interfere with the service, guess codes, get around blocks and checks.
If you find a vulnerability, do not use it and write to support@goswappix.app.
11.7. Leaving the service to get around the rules. Do not take a deal out of the service to get around limits or rules.
12. Complaints, decisions and appeals
12.1. How to complain. A member opens a case in their account or from a deal. Someone without an account writes to support@goswappix.app. In the complaint, state:
- what exactly was breached and why you think so;
- where it is: a link to the request, profile, review or deal;
- your name and email, if you have no account;
- a confirmation that the information is accurate and complete to the best of your knowledge.
12.2. What support decides. Only one thing: whether the platform rules were breached. For example fraud, pressure, threats, not turning up, swapping the recipient. Support does not decide who owes whom money and does not close the deal.
12.3. What support can do:
- ask members for facts;
- hide or delete a request, review or message that breaks the rules;
- give a warning;
- lower the trust level;
- restrict or suspend an account;
- block an account.
12.4. A decision with reasons. In a decision we state:
- what was established and what was not;
- which rule was breached;
- which measure was applied and for how long;
- how to appeal.
A lack of evidence does not mean anyone is honest or guilty.
12.5. Appeal. You can appeal a decision on a case in the service within 14 days. The appeal is reviewed by a different staff member, not the one who decided. They keep or change the decision. Appeals are free. If the law of your country gives you more time to appeal, write to support@goswappix.app after the 14 days and we will review the complaint in the same way.
12.6. Blocking. For a serious breach we block the account. What happens:
- all sessions are closed;
- requests are withdrawn and pending offers are cancelled;
- deals that have not started are cancelled;
- started deals are stopped, and the other side closes them under section 10;
- you can no longer sign in or sign up from that phone number and device. For this we keep not the number and the device tag themselves but their irreversible fingerprint (hash);
- the vouchers of the blocked member face consequences under section 14.
If you think the block is a mistake, write to support@goswappix.app. A person will review the decision.
12.7. Abuse of complaints. If someone often sends clearly unfounded complaints, we may stop reviewing them for a while, after warning them in advance.
12.8. Automation. Some checks are done by software: looking for contact details in text, limits, a warning before a harsh review. Decisions on blocking and on cases are made by a person.
13. Data, chat and disclosure
13.1. How we process data is described in the Privacy Policy.
13.2. The deal chat is visible only to the two members. The recipient does not see the chat. Support staff see the chat when they review a case about the deal.
13.3. A message can be edited within 5 minutes. If a message is edited or deleted, the original text is kept for reviewing cases. While a deal is stopped, messages cannot be edited or deleted.
13.4. We may hand data over to public authorities only if the applicable law requires it and the request is lawful.
13.5. You can download your data and delete your account in your account. While you have an open or stopped deal, the deletion is postponed. After deletion, deal records, messages and reviews remain, but without your name, phone number and nickname.
14. Reviews and vouches
14.1. Who writes a review. Only the two members of a completed deal, one review each. Once sent, a review cannot be changed.
14.2. Blind publication. Until the other member has written theirs, your review is hidden. Both reviews are revealed together. If the other member stays silent for 14 days, the first review is published alone.
14.3. Facts next to a review. Next to a review the service itself shows the facts of the deal: whether the receipt was confirmed, whether it was on time, whether the terms changed, whether there was a dispute.
14.4. Low rating. A 1–2 star rating needs a reason. You cannot choose a reason that the deal facts contradict. If the facts show nothing wrong, the service asks you to confirm the harsh review.
14.5. We do not remove a review because it is negative. We can remove a review only for breaking the rules: threats, personal data, inflation. If you think a review breaks the rules, open a case or write to support@goswappix.app.
14.6. Reply. The person the review is about can reply publicly once, without contact details.
14.7. The rating is the average of the latest ratings from each counterpart.
14.8. Reviews are the members' opinion, not ours. We do not check whether they are true, except for the deal facts that the service shows.
14.9. Vouching. You may vouch only for someone you know personally. Conditions:
- you have at least 1 completed deal and 7 days in the service;
- you have no active penalty;
- mutual vouching is not allowed.
Support staff may vouch without a completed deal and 7 days in the service.
14.10. Voucher's responsibility. If support has found the person you vouched for to be a violator, or they were blocked:
- for 90 days your trust level is one step lower;
- you cannot vouch for others during that time;
- this vouch can no longer be withdrawn.
A voucher is not liable with money and does not repay anyone's debt. If the decision is overturned on appeal or the block is lifted, the voucher's penalty is lifted too.
14.11. A vouch is not a guarantee. It does not promise that the person is honest.
15. Changes to the terms
15.1. We may change these terms: because of the law, new features, safety measures or errors in the text. We state the reason for the change.
15.2. We announce material changes at least 14 days in advance: in the service and by email, if you have added one.
15.3. Each edition has a number and a date. When a new edition comes out, the service asks you to agree to it at your next sign-in. You cannot sign in without agreeing. Deals already started are completed under the terms recorded in the deal.
15.4. If you do not agree, you can delete your account.
15.5. Edition 1 is currently in force. When the second edition comes out, a history of editions will appear on this page.
16. Liability
16.1. We are not responsible for:
- the actions and promises of other members and recipients;
- the money you handed over and its return;
- the authenticity of banknotes, amounts and details;
- the safety of a meeting;
- tax, currency and other consequences of your handovers;
- reviews and texts of other members.
16.2. How the service works. We try to keep the service running without interruptions but do not promise this. A code, SMS or Telegram message may arrive late: third-party operators deliver them. If the service is unavailable, do not confirm anything and wait.
16.3. Our liability. We are responsible for our own breaches of these terms and of the law. The limitations in this section do not apply if harm is caused intentionally or through gross negligence, if harm is caused to life or health, and where the law protects consumer rights and does not allow them to be limited.
16.4. The service is free. In all other cases, to the extent the law allows, we do not compensate indirect losses or lost profits.
16.5. Your liability. If claims are brought against us because you breached the law or these terms, you compensate our proven losses within the limits the law allows.
17. Termination
17.1. You can delete your account at any time in your account (section 13).
17.2. We may restrict or end access for a breach of these terms or the law, under the rules of section 12, with reasons.
17.3. We may close the whole service or part of it in a country if the law or a regulator requires it. We will warn you in advance where possible and give you time to finish started deals and download your data.
18. Law and disputes
18.1. These terms are governed by French law: the operating company is being registered in France.
18.2. If you use the service as a private individual, you keep the protection given to you by the mandatory rules of the law of the country where you live. These terms do not take it away.
18.3. If you have a claim against us, first write to support@goswappix.app. We will reply within 30 days and try to do so sooner.
18.4. If we cannot reach an agreement, the dispute is heard by the courts of France. A private individual may also go to court where they live, if the law allows it.
18.5. Users in the EU may also turn to a certified out-of-court dispute settlement body about moderation decisions, if the law gives them that right.
18.6. Money disputes between members are resolved between them, with the police or in court. We are not a party to them.
19. Apps and app stores
19.1. If you downloaded the app from the App Store or Google Play, the store's rules also apply. The store is not responsible for the Goswappix service.
19.2. You can also delete your account in the app.
20. Contact
Goswappix. The operating company is being registered in France; its name, address and registration number will appear here once it is registered.
Email: support@goswappix.app. We answer by email.
