Swappix Terms of Use

These Terms govern the use of the goswappix.app website, mobile applications, and Swappix services. By using the service or creating an account, you confirm that you have read and agree to these Terms and to our Privacy Policy.

Formal operator details will be published after the project operator has been registered. Until then, service questions, safety reports, legal notices, and personal-data requests should be sent to: support@goswappix.app.

1. Purpose of the service

Swappix is an information and communication online platform. The service helps users:

  • create a profile;
  • publish requests;
  • search for other users by selected parameters;
  • receive suggested matches;
  • exchange messages;
  • use reputation, moderation, and safety tools.

Swappix provides technological infrastructure for discovery, matching, and communication between users. Swappix is not a financial institution and does not replace your own legal, tax, or financial assessment.

2. Swappix is not a payment organization

Swappix:

  • is not a bank;
  • is not a payment institution;
  • does not open bank or payment accounts;
  • does not accept user funds;
  • does not hold user money;
  • does not transmit money;
  • does not execute payment orders;
  • does not issue electronic money;
  • does not exchange currency in its own name;
  • is not a party to settlements between users;
  • does not control user bank accounts;
  • does not provide escrow services;
  • does not guarantee completion of any arrangement between users.

Any lawful payments, transfers, exchanges, or settlements are performed by users independently, outside Swappix payment infrastructure, through independent organizations or methods chosen by them, where such actions are permitted by applicable law.

Payment for a Swappix subscription or other digital platform features is payment for platform services and is not part of any settlement between users.

3. Swappix is not a party to user arrangements

Swappix does not act as a user’s agent, representative, trustee, broker, payment intermediary, guarantor, or partner.

Users independently:

  • decide whether to communicate;
  • verify each other’s identity and reliability;
  • assess the legality of intended actions;
  • agree on terms;
  • choose an independent settlement method;
  • remain responsible for taxes, declarations, currency restrictions, and other obligations;
  • keep any necessary evidence and records.

Swappix does not confirm that a user has funds and does not guarantee the truthfulness of user statements.

4. Eligibility

You may use Swappix only if you:

  • are at least 18 years old;
  • have full legal capacity;
  • are not prohibited by law from using the service;
  • are not included in an applicable sanctions or restricted-person list;
  • do not use the service on behalf of a prohibited person;
  • provide accurate information;
  • comply with the laws of your location and the laws connected with your intended actions.

Swappix may restrict access from countries or territories where service creates unacceptable legal, sanctions, operational, or technical risk.

5. Registration and account security

You must:

  • provide accurate and up-to-date information;
  • use a secure sign-in method;
  • not transfer your account to another person;
  • immediately report unauthorized access;
  • not create multiple accounts to bypass limits;
  • not impersonate another person;
  • not use another person’s documents, photos, or data.

Your Swappix ID nickname is attached to your account and is not intended to be freely changed. One person should use one main account unless Swappix expressly allows otherwise.

You are responsible for actions performed through your account except where they result from Swappix’s breach of duty or circumstances for which you are not legally responsible.

6. Prohibited use

You must not use Swappix for:

  • money laundering or terrorist financing;
  • sanctions evasion, currency-control evasion, or bank-restriction evasion;
  • fraud;
  • use of stolen funds or payment instruments;
  • moving funds for an undisclosed third party;
  • unlawful banking, payment, or intermediary activity;
  • trade in drugs, weapons, forged documents, or other prohibited items;
  • extortion, threats, pressure, or blackmail;
  • exploitation of minors;
  • unlawful collection of personal data;
  • sale of accounts;
  • spam or mass unsolicited messages;
  • distribution of malicious code;
  • bypassing technical measures;
  • automated data scraping without permission;
  • rating manipulation;
  • false reviews;
  • publication of bank passwords, confirmation codes, CVV/CVC, or full card data;
  • infringement of intellectual property rights;
  • actions that could require Swappix to be licensed as a financial organization without Swappix’s prior written permission.

7. Especially risky conduct

Users must not:

  • accept money from one person while promising to pass it to another;
  • systematically provide money-transfer services to other users without required permissions;
  • present themselves as a Swappix employee;
  • promise a Swappix guarantee;
  • use the Swappix name in a payment reference as if Swappix is part of the transfer;
  • request passwords, PINs, CVV/CVC, or one-time bank codes;
  • persuade a user to install remote-access software;
  • send links to fake bank, payment-service, or Swappix pages.

8. Checks, moderation, and abuse prevention

For safety, Swappix may:

  • request email or phone confirmation;
  • require additional identity verification;
  • analyze technical risk signals;
  • check applicable sanctions and restricted lists;
  • temporarily limit features;
  • request explanations about suspicious activity;
  • block accounts connected with fraud or abuse;
  • retain information about violations;
  • disclose information to competent authorities where there is a lawful basis.

Requests may be moderated before publication. You may have up to three active requests at a time unless the interface or service rules state otherwise. Swappix checks are not a guarantee of user reliability and do not replace your own caution.

9. User content

You keep your rights to content you create.

By posting content in Swappix, you grant Swappix a non-exclusive, limited license to store, technically reproduce, transmit, and display that content only for:

  • providing the service;
  • moderation;
  • safety and security;
  • legal compliance;
  • protecting users and Swappix.

You confirm that you have the rights to post your content and that it does not violate third-party rights.

10. Visibility of profiles and requests

Before publication, the Swappix interface may indicate which information is available to:

  • all visitors;
  • registered users only;
  • users with whom a match exists;
  • moderation and safety staff only.

You must assess disclosure risks yourself and must not publicly post documents, bank details, home addresses, passwords, confirmation codes, or information that could give access to your accounts.

11. Complaints and appeals

A user or another person may report illegal content, suspicious activity, or rule violations to support@goswappix.app or through an in-product form where available.

Where possible, the notice should include:

  • an exact description of the violation;
  • a link or identifier of the profile, message, or request;
  • an explanation of why it is unlawful or violates these Terms;
  • contact details of the reporter;
  • a good-faith statement about the submitted information;
  • supporting materials.

Swappix reviews notices in a timely, objective, and good-faith manner and may remove content, limit visibility, temporarily restrict a feature, or restrict an account.

Users may appeal content removal, feature limitations, or account closure through support@goswappix.app. Clearly unfounded or repetitive appeals may be limited.

12. Termination and restrictions

You may delete your account in settings or request deletion through support.

Swappix may temporarily restrict or close an account if:

  • these Terms are violated;
  • false information was provided;
  • signs of fraud are detected;
  • service is prohibited by law;
  • a safety risk exists;
  • the user repeatedly creates risk for others;
  • a competent authority requires it;
  • the account remains inactive and retention is not required.

Where not prohibited by law and not creating additional risk, Swappix will communicate the main reason for restriction and provide an appeal opportunity.

13. Paid features

Swappix may introduce paid digital features, including subscriptions, additional filters, profile or request promotion, advanced settings, and other platform features.

Price, currency, subscription period, automatic renewal, and cancellation terms are shown before payment. Fees are not money-transfer commissions between users and do not depend on the success of user arrangements unless expressly stated and checked for compliance with applicable law.

Consumers keep mandatory rights, including pre-contractual information, cancellation, and refunds where required by the law of the user’s country.

14. Safety rules

Users are advised to:

  • never share bank passwords or one-time codes;
  • never provide remote access to their device;
  • avoid acting under pressure;
  • verify recipient details in a banking or payment app;
  • avoid acting for an unknown third party;
  • stop communication if fraud is suspected;
  • report suspicious profiles;
  • contact their bank, payment service, and law enforcement if funds are lost.

15. Disclaimer of warranties

To the extent permitted by applicable law, the service is provided “as is” and “as available.”

Swappix does not guarantee:

  • uninterrupted operation;
  • absence of errors;
  • accuracy of user content;
  • legality of another user’s intentions;
  • availability of another user’s funds;
  • successful completion of an arrangement;
  • absence of fraud;
  • any specific financial result;
  • availability in all countries.

This section does not limit mandatory consumer rights or liability that cannot be excluded by law.

16. Limitation of liability

To the extent permitted by law, Swappix is not liable for:

  • user actions outside the service;
  • terms voluntarily agreed by users;
  • independent banking, payment, or other services;
  • losses caused by a user sharing passwords or codes;
  • the legality of an individual user arrangement;
  • exchange-rate, tax, or currency-control consequences;
  • indirect losses or lost profits.

Nothing in these Terms excludes liability for intent, gross negligence, death or personal injury, breach of mandatory consumer-protection rules, or any other liability that cannot be excluded by law.

No provision of these Terms deprives a consumer of mandatory protection under the law of their country of habitual residence.

17. Intellectual property

Swappix software, design, trademarks, text, and other materials belong to Swappix or are used under license.

You receive a limited, revocable, non-transferable right to use the service for personal lawful purposes.

You must not copy, sell, decompile, create derivative products, or use the Swappix brand without written permission except where expressly permitted by law.

18. Changes to the service and Terms

Swappix may change the service and these Terms for legal, technical, safety, or commercial reasons.

Material changes that worsen the position of a registered user will be notified in advance within a reasonable period unless immediate change is required by law or safety.

Continued use after the effective date of changes means acceptance of the new version unless the law requires separate consent.

19. Governing law and disputes

Governing law, court, or arbitration terms will be specified after the project operator has been registered. Until then, users may send complaints to support@goswappix.app. Swappix will try to respond within a reasonable period.

Nothing in these Terms limits mandatory consumer rights under the law of the user’s country of habitual residence.

20. Severability

If any provision is found invalid, the remaining provisions remain in effect. The invalid provision applies to the maximum extent permitted by law or is replaced by a valid provision closest to the original purpose.

21. Entire agreement

These Terms, the Privacy Policy, community rules, paid-feature terms, and other documents referenced by the Swappix interface form the agreement between the user and Swappix.
